LIABILITY WAIVER & RELEASE

 

In summary:

You acknowledge that you have carefully read this “waiver and release” and fully understand that it is a release of liability. You expressly agree to release and discharge the trainer or instructor, and Pilates AURA the company, from any and all claims or causes of action and you agree to voluntarily give up or waive any right that you may otherwise have to bring a legal action against the trainer or instructor, and Pilates AURA the company, for personal injury or property damage. To the extent that statute or case law does not prohibit releases for negligence, this release is also for negligence. If any portion of this release from liability shall be deemed by a Court of competent jurisdiction to be invalid, then the remainder of this release from liability shall remain in full force and effect and the offending provision or provisions severed here from. By purchasing a plan in order to participate in online class sessions or workshops, you acknowledge that you understand its content and that this release cannot be modified orally.

 

More specific:

By purchasing a plan through Pilates AURA for online exercise services, you understand that you have enrolled in a program which may involve strenuous physical activity including, but not limited to, muscle strength and endurance training, cardiovascular conditioning and training, and other various fitness activities. You hereby affirm that you are in good physical condition and do not suffer from any known disability or condition which would prevent or limit your participation in this exercise program, or have consulted with your physician and understand your risks.  You acknowledge that your enrollment and subsequent participation is purely voluntary and is in no way mandated. 

 

In consideration of your participation in any online services offered through the Pilates AURA website, you hereby release Pilates AURA, and Cecilia Pulido from any liability, claims, demands, and causes of action as a result of your voluntary participation and enrollment, understanding that you may injure yourself as a result of your enrollment and subsequent participation in this online programming.  You hereby release Pilates AURA, Cecilia Pulido from any claims that may arise in the future as the result of injury or loss you suffer as the result of negligence by Pilates AURA, Cecilia Pulido in the provision of services to you. These conditions may include, but are not limited to, heart attacks, strokes, muscle strains, muscle pulls, muscle tears, broken bones, shin splints, injuries to knees or other joints of the body, injuries to back or neck, injuries to a foot, heat prostration, or any other illness or soreness that you may incur, including emotional distress, and death.

In consideration of your voluntary participation in online classes, you further agree to INDEMNIFY AND HOLD HARMLESS Pilates AURA, Cecilia Pulido, and any other instructor, authorized by the owner, to teach class on this digital platform. 

 

Photo release:

Pilates AURA, Cecilia Pulido periodically takes photographs and/or video for advertising purposes including but not limited to print ads and website. You hereby grant Pilates AURA, Cecilia Pulido permission to use your likeness in a photograph in any and all of its publications, including website entries, without payment or any other consideration. You understand and agree that these materials will become the property of Pilates AURA, Cecilia Pulido and will not be returned. You hereby irrevocably authorize Pilates AURA, Cecilia Pulido to edit, alter, copy, exhibit, publish or distribute this photo for purposes of publicizing Pilates AURA, Cecilia Pulido programs or for any other lawful purpose. In addition, you waive the right to inspect or approve the finished product, including written or electronic copy, wherein your likeness appears. Additionally, you waive any right to royalties or other compensation arising or related to the use of the photograph. You hereby hold harmless and release and forever discharge Pilates AURA, Cecilia Pulido from all claims, demands, and causes of action which you, your heirs, representatives, executors, administrators, or any other persons acting on your behalf or on behalf of your estate have or may have by reason of this authorization. You are 21 years of age and are competent to contract in your own name.

Refund Policy

At Pilates Aura we strive to meet the needs of all of our clients.  If you are not satisfied with our service, we would be happy to provide a refund of the remaining balance of the package you purchased, minus the classes you attended at the $15/class rate, and a nominal processing fee of $15. Valid only during the active month of the plan.  Please contact us at info@pilatesaura.com.

 

Account Hold:

In today’s ever changing world we understand that your life situations may change.  We would be happy to freeze your account for your choice of 30 to 60 days. Please contact us at info@pilatesaura.com to let us know how we can support you.  We kindly request that you provide us with at least 3 working days notice when putting a hold on your account.
